Boomie Terms and Conditions

Welcome to Boomie, a peer-to-peer rental platform dedicated to connecting communities for the rental of clothing and accessories. By accessing or using our services, you agree to the following Terms and Conditions (“Terms”).

  1. Introduction

    Boomie (“we”, “us”, “our”) operates a platform that facilitates the rental and lending of clothing and accessories between users (“you”, “your”). By using Boomie, you agree to be bound by these Terms, our Privacy Policy, and any other agreements or guidelines we may provide.

    These Terms and the Privacy Policy may change at any time. If we do make changes, we will place a notice on our Website and App. We may also send you an email and/or notify you by some other means. Changes take effect on the date set out at the end of these Terms. You should check our Terms often to stay informed of any changes that may affect you. Your continued use of the Website and/or App and/or Services after we change the Terms constitutes your acceptance of the changes. If you do not agree to any of the changes, you must cancel your account and not use any portion of the Services.

  2. Eligibility

    To use Boomie, you must be at least 18 years old and legally capable of entering into binding contracts. By registering on Boomie, you confirm that you meet these criteria and agree to abide by all applicable laws and regulations.

  3. Services and Use of the Platform
    1. Services

      The Services provide a peer-to-peer marketplace (“Marketplace”) that allows third-party lenders (“Lenders”) to list and rent out (or in some instances sell) their clothing, accessories, and shoes (“Items”) to third-party renters (“Renters”) using our mobile application (“App”) or websitewww.boomie.rent (“Website”). The Marketplace, App, and the Website together constitute the services we provide to you (the “Services”).

      Boomie facilitates lending between users. Boomie provides the Marketplace to allow Lenders and Renters to facilitate rentals directly by and between each other. Boomie does not monitor the quality of the items made available for rent and is not involved in the setting of prices – these are entirely up to the relevant Lender’s discretion.

      The agreement is formed on acceptance of a rental on the Marketplace and is solely between the Lender and the Renter. Boomie does not manufacture, store, deliver or inspect any of the items sold or rented via the Marketplace, and we do not provide any warranties with respect to the items that are available to be purchased or rented via the Marketplace, or any of the descriptions for such items.

    2. Refund and Exchanges.

      Refunds and Exchanges. The Company does not handle returns, refunds or exchanges in connection with Transactions. If a purchased or rented item does not fit or is not as described, the user purchasing or renting the item must contact the user that has rented or sold the item about any refund or exchange that may be available. However, the Company provides a Purchase Protection Policy. The Company may also help users resolve disputes related to Transactions in good faith and in its sole discretion, but is not under any responsibility to do so.

    3. Rental Process.

      A rental transaction is initiated when a Renter requests an item and the Lender confirms the booking. This forms a binding agreement between the Lender and Renter, with Boomie acting as a facilitator. Both parties are expected to uphold their obligations as outlined in these Terms.

    4. Account Registration and Responsibilities.

      Both Lenders and Renters must register and create an account to access our Marketplace to lend or rent items. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities conducted under your account. You may provide certain information such as your first and last name, contact details, and billing information. We may also require additional forms of identification in order to verify your identity. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

    5. Account Deactivation.

      You may deactivate your account at any time by emailing help@boomie.rent and requesting that your account be deactivated. Please include “Account Deactivation” in the subject line of the email.

  4. Right to Use Services and Your Content
    1. Right to Use Services.

      We hereby permit you to use the Services for your personal, non-commercial use only, provided that you comply with these Terms in connection with all such use. The materials and content comprising the Services (excluding any Third-Party Materials and User Content) belong to us or our third-party licensors and you agree that you have no rights in the Website, the App or any part of the Service other than the right to use and access the Service in accordance with these Terms.

      Your right to use the Services is personal to you, and you are not allowed to give this right to any other person.

      The Website, the App and the Services could include technical inaccuracies or typographical errors. We shall have no liability in connection with any such inaccuracies or errors, nor shall we have any obligation to identify and/or correct any such inaccuracies or errors.

      If there any links to third-party websites provided, (“Linked Websites”), Boomie does not endorse or sponsor any Linked Websites and is not responsible for the availability, accuracy, content, or any other aspect of the Linked Websites. Boomie disclaims all liability for such Linked Websites, for all access to and use thereof, and for use of the links to such Linked Websites.

      Where you download the App via the Apple app store (“Apple App Store”), you will be subject to the specific Apple App Store terms, governing your use of the Apple App Store.

    2. Restrictions on Your Use of the Services.

      Unless expressly permitted by us, you may not:

      1. Rent or make available for sale any items that are not lawfully yours or that you don’t have permission to sell or make available;
      2. Copy, or attempt to copy, the Website, the App or any part of the Service;
      3. Give or sell or otherwise make available the Website, the App or any part of the Service to anyone else;
      4. Change, edit, modify, distribute, duplicate or attempt to change, edit, modify, distribute, or duplicate the Website, the App or any part of the Service in any way;
      5. Access or look for the underlying code of the Website, the App or any party of the Service that we have not expressly published publicly for general use;
      6. Use automation software (bots), software, process, hacks, or means to access, retrieve, scrape or index any portion of our Site, App, or its content. This includes engaging in any scraping, data mining, gathering or extraction methods on our Services;
      7. Submit, display, post or store any content that is inaccurate, unlawful, defamatory, obscene, excessively violent, pornographic, invasive of privacy or publicity rights, harassing, threatening, abusive, inflammatory, harmful, hateful, cruel or insensitive, deceptive, or otherwise objectionable.
      8. Use the Services for illegal, harassing, bullying, unethical or disruptive purposes, or in a manner that is obscene, excessively violent, harassing, harmful, hateful, cruel or insensitive.
    3. Uploaded Content.

      You confirm that any images, text or information that you upload to Boomie, including any reviews that you post about other users or items (collectively, the “User Content”) will meet our Acceptable Use Policy.

      Boomie does not claim ownership of your User Content, and ownership will remain with you and any third party whose content you upload to the Service. You grant us a worldwide, non-exclusive, royalty-free and perpetual license to use, copy, reproduce, distribute, adapt, re-format, modify, publish, translate, license, sub-license and otherwise make available the User Content anywhere and in any form for the purposes of providing the Service (including allowing all users of the Service to view and use your User Content). You are solely responsible for ensuring that you have the necessary rights in all User Content to allow Boomie to use the User Content and shall be solely liable if any of your User Content violates or infringes the intellectual property or privacy rights of any third party.

      We have the right to reject, refuse or delete any User or User Content at our sole discretion where we think that it breaks any provisions of our Acceptable Use Policy.

  5. Lender Terms
    1. Item Categories.

      You can list any item related to the Item Categories in our dropdown menu on the Listing page. If the item you want to list doesn’t match any of our designated categories, please reach out to hello@boomie.rent.

    2. Item Descriptions.

      All items must adhere to the description you provide. You are responsible for ensuring that all items listed are suitable for their intended use and safe. Any damage must be detailed in the item description and/or shown in the photos.

    3. Listing an Item.

      Once your account is set up, you can begin listing items for rent. You are fully responsible for the accuracy of the information provided about the item. When you submit a new listing, Boomie will approve the category and placement on the Website and App. After approval, your listing will appear on Boomie, enabling you to accept rental requests and monitor payments. Boomie does not verify listings for price, quality, or accuracy but ensures they are placed in the correct category.

    4. Item Images.

      Boomie requests that you provide images of yourself modeling the items you wish to rent out. All images must comply with our Acceptable Use Policy and must be your own, without infringing on any intellectual property or privacy rights. Boomie will upload the images “as is” and holds no responsibility or liability for the images. Boomie reserves the right to rank listings on the website/app based on internal algorithms, and is not liable for the positioning of your listings.

    5. Proof of Condition.

      In addition to the item images provided for listing, Lenders show up-to-date photos of the items current condition. These photos should show any existing damage (if applicable) and the item’s condition. Without these photos, Boomie may not be able to assist in disputes regarding damage during a rental.

    6. Repeat Cancellations.

      If a Lender is repeating cancelling on requested rentals, Boomie reserves the right to publish a review indicating the cancellation and may “pause” wardrobes due to inactivity or repeated declined or expired rentals.

    7. Lender’s Responsibilities.

      As the Lender, you are responsible for ensuring:

      1. The items you list for rent are accurately described, in good condition, and compliant with Boomie’s guidelines.
      2. You agree to handle shipping and cleaning of the items, as specified by Boomie, and to resolve any disputes with Renters in good faith.
      3. You deliver rented items to the Renter as per the agreed terms.
      4. Ship, or coordinate pickup of, the Item by the Rental Start Date, at the latest.
        1. Lenders are responsible for the shipping payment, if any, that is required for the item to be sent from the Lender to the Renter.
      5. Descriptions of listed items are accurate and include all relevant information for their use.
      6. The items you list:
        1. Match the pictures or descriptions you provided.
        2. Are safe to use, following any instructions you provide.
        3. Are fit for their intended purpose or any purpose communicated by the Renter.
        4. Can be legally offered for rent.
    8. Lender Rental Policy.

      You are responsible for setting the terms on which you lend an item, including:

      1. Item Price: The rental fee you charge (on daily, weekly, and monthly basis).
      2. Delivery: How you would like to deliver the item to the Renter (either shipping or coordinate a pickup).
    9. Delivery of Item.

      You are responsible for delivering the item to the Renter, whether it is shipping or coordinating a pickup with the Renter at an agreed-upon location. The Lender is also responsible for all delivery costs when sending the item to the Renter. The Renter is responsible for all delivery costs when sending the item back to the Lender.

      Please note the following best practices:

      1. Shipping: Boomie recommends sending all items by tracked and insured shipping methods. The sender will be liable to the other party for any loss or damage to items occurred during shipping. Boomie is not liable for any such loss or damage.
      2. Tracking: You must provide a tracking number for every item sent. If tracking is not available, Boomie may be unable to help resolve any disputes related to the rental. Once tracking information is provided, the recipient is responsible for being available to receive the delivery on the expected date. If tracking information is not provided, Boomie may assume the item has not been sent, and Lender Late Fees and/or Boomie Legal Fees may be applied as a result.
    10. Refund Policy

      A renter may request a refund in respect to a rental item, under the following scenarios:

      1. The item not as described or is defective.
        1. The Renter is entitled to a FULL refund from the Lender if the items is sent within 24 hours of receiving the item and is in unworn condition.
        2. The Lender is still required to pay the Commission to Boomie.
      2. The item does not arrive by the Rental Start Date.
        1. The Renter is entitled to a FULL refund from the Lender if the items is sent within 24 hours of receiving the item and is in unworn condition.
        2. The Lender is still required to pay the Commission to Boomie.
      3. The Lender cancels a confirmed rental request.
        1. The Renter is entitled to a FULL refund of all fees.
        2. The Lender is still required to pay the Commission to Boomie.
    11. Terms of Rental.

      Once you and a Renter agree on the rental terms, you cannot amend those terms unless justified and agreed to in writing.

    12. Removing or Canceling a Listing:

      You may remove a listing or cancel an agreement up to 48 hours before the rental period or with the Renter’s consent. If you cancel within 48 hours of the rental start date, Boomie reserves the right to charge a cancellation fee of 40% of the Rental Fee.

  6. Renter Terms
    1. Renter’s Rights.

      By renting an item, you receive a limited right to use it for the agreed rental period. This right is personal and non-transferable.

    2. Renter’s Responsibilities.

      As the Renter, you agree to treat all rented items with care and return them in the condition received, subject to normal wear and tear. You are responsible for any damage beyond normal wear and tear and may be charged for repair or replacement costs. Renters must ship the Item by the Rental End Date, at the latest. It should be scheduled to reach the Lender within 1-3 business days. Renters are responsible for the shipping payment, if any, that is required for the item to be sent back from the Renter to the Lender. As the Renter, you are responsible for ensuring:

      1. You are legally allowed to use any item that you borrow through the Service
      2. You comply with all applicable law when using the item
      3. You comply with any reasonable directions provided by the Lender in order to use the item safely
      4. You return the item in the same condition as it was when you collected or received it from the Lender
    3. Returning Item.

      You can arrange with the Lender how you will return the rented items, but you must make sure to return them on the agreed-upon return date unless the Lender allows an exception.

      You must ensure that you delivery or plan a collection of the Item by at least the Last Day of the Rental Period. If shipping, it should reach the Lender within 1-3 business days. Please note, that the full cost of delivery in returning the item is borne by the Renter.

    4. Delivery of Item.

      You are responsible for delivering the item back to the Lender, whether it is shipping or coordinating a pickup with the Lender at an agreed-upon location. The Renter is also responsible for all delivery costs when sending the item to the Lender. The Lender is responsible for all delivery costs when sending the item initially to the Renter.

      Please note the following best practices:

      1. Shipping: Boomie recommends sending all items by tracked and insured shipping methods. The sender will be liable to the other party for any loss or damage to items occurred during shipping. Boomie is not liable for any such loss or damage.

    5. Failure to Return Item on Time.

      If you fail to return an item by the agreed return date, you must contact the Lender to notify them immediately and let them know you are going to miss the agreed return deadline. You must extend your rental period and pay for the additional time right away unless the Lender agrees to different terms. If the Lender is unable to accommodate the extension, you are solely responsible for returning the item(s) to the Lender as soon as possible, and no later than the date specified by the Lender.

      You also may be subject to the following:

      1. Renter Late Fee: If you do not return the items by the Lender’s required date, the Lender may charge you a fee equal to the daily rental rate plus an additional 25%. For example, if the rental fee is $10 per day, you will be charged $12.50 per day until the item is returned. The Lender is allowed to send you an invoice directly for these fees.
      2. Boomie Late Fee: If you fail to return the items by the Lender’s required date, Boomie may charge your payment method for any reasonable legal costs incurred by Boomie or its partners in recovering the items.
    6. Loss or Damage of Rental Item.

      Boomie holds no responsibility if an item is lost or damaged, and the Lender may seek compensation from the Renter for repair or replacement costs. The Lender has the sole discretion to charge a fee for any damage or loss of their item, including costs related to repair, extra cleaning, or replacement. They are entitled to invoice the Renter for such fees. The Renter must inform the Lender as soon as possible about any damage that occurs during the rental period. The Lender, in turn, must notify the Renter of any damage within 24 hours of receiving the returned items. Repeated rentals are at the Lender’s risk. Renters are not liable for normal wear and tear, which includes stains that can be removed with proper cleaning, minor snags, small numbers of missing beads, stuck zippers, or other minor issues. Boomie customer support may assist in determining what constitutes fair wear and tear versus actual damage.

    7. Theft.

      Stealing of any item is strictly not tolerated on our platform. If you steal or attempt to steal an item, the Lender and/or Boomie shall be entitled to take legal action against you.

  7. Payments and Fees
    1. Rental Fee.

      You can find the fees for renting an item on the relevant listing page (“Rental Fee”). The Renter will need to pay the Rental Fee via Stripe and will be subject to Stripe’s Terms and Conditions of Use.

    2. Service Fee.

      Boomie charges a service fee on each transaction. All payments, including rental fees, shipping costs, and applicable taxes, are processed through our third-party payment provider. Lenders will receive payouts after the item is returned and inspected, minus Boomie’s service fee.

    3. Lender Payment.

      If you are a Lender, Boomie will collect the Rental Fee on your behalf. Boomie’s commission on the Rental Fee (“Commission”) is at a rate of 15%. The Lender shall receive the Rental fee, minus the Commission, within 24 hours of the Rental Fee payment having been completed by Stripe, our payment provider. Boomie is not responsible if payment is delayed for whatever reason.

    4. Right to Charge Your Payment Method.

      If you fail to pay the Rental Fee or any additional fees on time or otherwise damage, steal, or lose an item, Boomie shall be entitled to take payment from you via Stripe.

  8. Cancellations and Refunds.

    Boomie reserves the right to cancel any rental transaction at our discretion and will notify both parties accordingly.

    1. Cancellation by Renter.

      A Renter may cancel a booking before the item is accepted and no payment will be deducted from your account. If you cancel after the item has been accepted, no refund will be issued.

    2. Cancellation by Lender.

      A Lender may cancel a booking before shipping, but frequent cancellations may result in penalties or account suspension.

  9. Item Condition, Damage, and Resolution
    1. Item Condition.

      Lenders must accurately represent the condition of their items. Renters must inspect the item upon receipt and report any issues immediately.

    2. Damage.

      If an item is damaged during the rental period, the Renter may be charged for repair or replacement costs. If the Item is damaged or not in the condition represented on the listing page, the Renter is entitled to a refund if noted withing 24 hours of receipt.

    3. Resolution.

      Boomie encourages all users to resolve any disputes directly with each other. If you are unable to resolve a dispute, Boomie will try and help resolve the issue. You can contact our team by emailing us at hello@boomie.rent. You must provide complete details of the dispute along with sufficient evidence of any damage or loss suffered. If you are unable to provide sufficient evidence, Boomie will not be able to help you resolve or mediate the dispute. All disputes must be raised within 7 days of the rental end date. Disputes raised more than 7 days after the rental end date will not be considered.

  10. Prohibited Items and Activities

    The following items and activities are prohibited on Boomie:

    1. Listing counterfeit or non-authentic items
    2. Listing items that violate any laws or third-party rights
    3. Engaging in fraudulent, illegal, or harmful activities

    Boomie reserves the right to remove any content or listings that violate these Terms or our policies.

  11. User Conduct and Community Guidelines

    Users are expected to conduct themselves with integrity and respect for others. Any behavior that disrupts the community, including harassment, abuse, or violation of another user’s rights, may result in account suspension or termination.

  12. Intellectual Property

    All content and materials on Boomie, including logos, trademarks, and website design, are the property of Boomie or its licensors. You may not use, reproduce, or distribute any content without our prior written consent.

  13. Disclaimers and Limitation of Liability

    Boomie provides the platform “as is” without warranties of any kind, express or implied. We do not guarantee the quality, safety, or legality of items listed on our platform. Boomie shall not be liable for any damages, including direct, indirect, incidental, or consequential damages, arising from your use of our services, to the fullest extent permitted by law.

  14. Indemnification

    You agree to indemnify, defend, and hold harmless Boomie, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the platform, your breach of these Terms, or your violation of any law or the rights of a third party.

  15. Termination

    Boomie may, in its sole discretion, suspend or terminate your account and access to our services at any time, with or without notice, for any reason, including violation of these Terms.

  16. Changes to Terms

    Boomie reserves the right to modify these Terms at any time. Any changes will be posted on our platform, and your continued use of the services after such changes constitutes acceptance of the new Terms.
